Terms of Use of the Justices of the Peace On-line Register

Important notice

The Justices of the Peace On-line Register is provided under the provisions of the New South Wales Justices of the Peace Act 2002 and is administered on behalf of the State of New South Wales by the New South Wales Department of Communites and Justice. It includes only Justices of the Peace that are currently registered in the State of New South Wales.

Strict conditions apply to the use of the Justices of the Peace On-line Register and these are set out in these Terms of Use. Before accessing the Justices of the Peace On-line Register you must read these Terms of Use and by accessing the Justice of the Peace On-line. Register you are acknowledging your acceptance of these Terms of Use. If you do not wish to accept these Terms of Use then you must not proceed to access the Justices of the Peace On-line Register.

The State of New South Wales reserves the right to modify, alter or update these Terms of Use at any time, without notice.

Breach of Terms of Use

Breach of any of these Terms of Use, or any unlawful activity in connection with the Justices

of the Peace On-Line Register, may result in civil and/or criminal prosecution under any applicable Commonwealth and/or New South Wales laws, or result in other legal action.

The State of New South Wales reserves the right to review, block or reject any communication in connection with the Justices of the Peace On-line Register that it considers to be in breach of the conditions of use of the Justices of the Peace On-line Register, or otherwise unlawful or unacceptable.

Any identified breaches of applicable laws may be referred by the State of New South Wales or its employees or agents to an appropriate law enforcement agency or other entity for appropriate action, criminal and/or civil.

 Surveillance

Your use of the Justices of the Peace On-line Register may be monitored continuously or intermittently at any time to ensure that it is lawful and that it complies with the conditions of use.

Acceptable use of the Justices of the Peace On-line Register

The provision of the Justices of the Peace On-line Register is in furtherance of the Justices of the Peace Act 2002, in particular to enable persons in the State of New South Wales to locate a Justice of the Peace or to confirm a person's current registration as a Justice of the Peace so as to facilitate the provision of Justice of the Peace functions in New South Wales.

You should keep in mind that the Justices of the Peace listed on the register are volunteers and that they may not be available at short notice or at all times of the day. When seeking the services of a Justice of the Peace, you should telephone in advance to make an appointment. It is best to telephone during weekday business hours. If urgent contact outside of business hours or on a weekend is necessary, try to limit your call to a reasonable time of the day.

No misuse of the Justices of the Peace On-line Register

If you access the Justices of the Peace On-line Register, you must only use the information contained on the Justices of the Peace On-line Register to locate a Justice of the Peace or to confirm a person's current registration as a Justice of the Peace so as to facilitate the provision of Justice of the Peace functions in New South Wales. You must not, at any time whatsoever:

  1. use information obtained from the Justices of the Peace On-line Register about any Justice of the Peace to send unsolicited communications (whether of a commercial or non-commercial or other nature) to that Justice of the Peace or any other person or entity connected to that Justice of the Peace other than communications necessary to enable you to make legitimate use of the Justices of the Peace's services as allowed by law;
  2.  undertake data harvesting of personal information from the Justices of the Peace Online Register;
  3. make any illegal, spurious, malicious or fraudulent use or any other misuse of the Justices of the Peace On-line Register;
  4. introduce any "virus", "worm", "Trojan Horse" or any other computer software or do anything else that is intended or designed to:
    1. permit unauthorised access to or use of the Justices of the Peace On-line Register;
    2. disable, damage, erase, disrupt or impair the normal operation of the Justices of the Peace On-line Register;
  5. reproduce, incorporate or store any information from the Justices of the Peace On-line Register without the prior written consent of the State of New South Wales (acting through the Department of Communities and Justice).

Jurisdiction

The terms and conditions governing access to and use of the Justices of the Peace On-line Register shall be governed by, construed and enforced in accordance with the laws (Commonwealth and State) in force in the State of New South Wales. These laws include, but are not limited to, Commonwealth and State privacy and criminal laws, the Copyright Act 1968, and the Spam Act 2003, among others.

The Spam Act 2003

The Commonwealth Spam Act 2003 regulates the sending of unsolicited commercial electronic messages and generally prohibits the sending of such messages. An unsolicited commercial electronic message may include a message sent by short message service (SMS), multimedia message (MMS), instant messaging (iM) or e-mail. The Spam Act 2003 also prohibits the use of address-harvesting software or harvested-address lists used for the purpose of sending an unsolicited commercial electronic message.

The Spam Act 2003 is currently enforced by the Australian Communications and Media Authority (ACMA) and provides for penalties of up to $1.1 million for each contravention. The State of New South Wales reserves the right to refer any possible breaches of the Spam Act 2003 that come to its attention to ACMA or other appropriate law enforcement agency.

Copyright

The Justices of the Peace On-line Register contains information, data, images, graphics and other materials ("material") that has been prepared by or on behalf of the State of New South Wales (acting through the Department of Communities and Justice).

Unless indicated otherwise, all such material is subject to copyright under the Commonwealth Copyright Act 1968 and is either owned by or licensed to the State of New South Wales (acting through the Department of Communities and Justice).

In addition to any conditions on acceptable use elsewhere in these Terms of Use or as otherwise allowed by the Copyright Act 1968, you must not

  1. copy, reproduce or publish any material from the Justices of the Peace On-line Register for any purpose, whether commercial or non-commercial or of any other nature whatsoever;
  2. distribute any material on the Justices of the Peace On-line Register to others, including via email or by posting on the Internet;
  3. modify or tamper with any material on the Justices of the Peace On-line Register;

No tampering

You must not remove any copyright notice, or any technological protection measure or electronic rights management information attached to or embodied in any material on the Justices of the Peace On-line Register.

Links to Justices of the Peace On-line Register

You must not establish any link to the Justices of the Peace On-line Register without the prior written consent of the State of New South Wales (acting through the Department of Communities and Justice).

Consent may be either withheld, or otherwise granted conditionally or unconditionally, in the absolute discretion of the State of New South Wales (acting through the Department of Communities and Justice) and without the need for reasons to be given.
