Justice of the Peace Handbook 2022

The new Justice of the Peace (JP) Handbook is now available!

The revised JP Handbook details new processes such as enabling legal documents to be witnessed remotely via audio visual technology and changes to acceptable forms of identity to include Digital Driver License, plus additional information to improve accessibility for people from different cultural and linguistic backgrounds.

You can download a free copy of the complete handbook (PDF, 2.5 MB) or download it in sections from the handbook page.

You can purchase a printed copy of the new JP Handbook through your JP Online account.

We would recommend JPs to take the time to read the new handbook, before they perform their functions as a JP.

JPs: Introducing Integrated Birth Certificate for adopted persons

New type of birth certificate for adopted persons

From 16 November 2020, where a person is adopted and the adoption order is registered in NSW the NSW Registry of Births, Deaths and Marriages (BDM) will automatically issue an Integrated Birth Certificate (IBC), along with the existing post-adoptive birth certificate, on receipt of an application.

The IBC is a new type of birth certificate providing an alternative for adopted persons that includes information about parents and older siblings at birth, as well as parents and older siblings after adoption. It does not, however, change the legal effect of adoption and the person's legal name and legal parents are clearly noted.

This means that you may now see two different kinds of birth certificates:

  • a standard birth certificate, such as those you will have previously seen. These birth certificates list the legal parents and siblings of the person.
  • an Integrated Birth Certificate (IBC), which also lists the legal parents and siblings of the person, but also includes an extra column listing the birth parents and siblings of an adopted person

For an existing adoption that was registered in NSW prior to this date, an adopted person or some family members can apply for an IBC. Please refer to the Integrated Birth Certificates Fact Sheet, for further information.

Identity documents

NSW JPs should be aware of this new type of birth certificate.  NSW JPs may be asked to witness and certify copies of original IBCs. An IBC and post-adoptive birth certificate are both valid identity documents, and an adopted person may choose to use either birth certificate for identification purposes. Both certificates contain the same identifying registration number.

NSW JPs can now witness interstate documents

The NSW Government has recently changed the law to allow NSW JPs to witness the execution of documents to be used interstate, where already authorised to do so in those jurisdictions. This means that NSW JPs can now witness interstate documents (such as Queensland land titles documents) when allowed by the law of the other state. For more information, please read Witnessing overseas and interstate documents.
