Antisocial behaviour has a significant impact on the quality of life of vulnerable people through fear of crime and the long term effects of victimisation. It also gives rise to additional costs for a wide range of organisations and individuals including families, the NSW Police Force, non-government organisations, local government, social housing providers and businesses.

On 15 October 2019, the Department of Communities and Justice (DCJ) commenced a statutory review of section 154D and section 154G of the Residential Tenancies Act 2010. These provisions help to strengthen DCJ’s management of antisocial behaviour (ASB).

Section 154D provides for the mandatory termination of a social housing tenancy by the NSW Civil and Administrative Tribunal in certain circumstances; and section 154G provides for orders for possession taking effect no later than 28 days after the order being made.

The Minister for Families, Communities and Disability Services is required to review sections 154D and 154G of the RTA (in accordance with section 228 of the RTA) to determine whether the policy objectives of the sections remain valid and whether the terms of the sections remain appropriate for securing those objectives.
