Review of the Terrorism (Police Powers) Act 2002

The Terrorism (Police Powers) Act 2002 confers special powers on police officers to respond to terrorist activity and terrorist attacks.

Section 36 of the Act requires the Attorney General to undertake a review of the Act in order to determine whether the policy objectives of the Act remain valid and whether the terms of the Act remain appropriate for securing those objectives. The Department of Justice is conducting the review on behalf of the Attorney.

The Acting Ombudsman recently released a report on a review of the exercise of powers under Parts 2A and 3 of the Act. A copy of that report is available on the NSW Ombudsman's website.

• The report covers the period from 1 January 2014 to 31 December 2016.
  
• The Acting Ombudsman's main recommendation was that Part 2A of the Act (Preventative Detention Orders) be allowed to expire in December 2018.
  
• The Acting Ombudsman's report and recommendations will be considered as part of our review.
