Review of the Inspector of Custodial Services Act 2012

The NSW Department of Communities and Justice is conducting a review of the Inspector of Custodial Services Act 2012 (the Act) to determine whether its policy objectives remain valid, and whether its terms remain appropriate for securing those objectives.

This review is required by section 28 of the Act.

About the Act

The Act establishes the office of the Inspector of Custodial Services and confers on the Inspector powers necessary for the exercise of various functions relating to the inspection and review of custodial centres and custodial services in NSW. The Act commenced on 30 August 2013 and can be viewed in full on the NSW legislation website.

The policy objectives of the Act include:

  • to provide independent scrutiny of the conditions, treatment, and outcomes for adults and young people in custody
  • to ensure that each adult custodial centre is inspected once every five years, and every youth justice centre once every three years.
