Administrative review of the Bail Act 2013

The NSW Department of Communities and Justice is reviewing the Bail Act 2013 (NSW) to determine whether the policy objectives of the Act remain valid and whether the terms of the Act remain appropriate for securing those objectives.

About the Act

The Act establishes a legislative framework for a decision as to whether a person who is accused of an offence or is otherwise required to appear before a court should be detained or released, with or without conditions.

The policy objective of the Act is to ensure a strong and clear regime for bail decision-makers that ensures consistency of decisions and community safety, and reflects the seriousness of the alleged offending.

The Act commenced on 20 May 2014 and can be viewed on the NSW legislation website.
